1. Acceptance of Terms
By accessing or using Capture ("the Service"), operated by Kyx AI ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Capture provides a Chrome extension and web application that allows users to record interactions on web pages and automatically generate step-by-step guides with screenshots. The Service uses AI to process recordings and generate guide descriptions.
3. Account Registration
You must create an account to use Capture. You are responsible for maintaining the security of your account credentials. You must provide accurate information and keep it up to date. You are responsible for all activity under your account.
4. Acceptable Use
You agree not to:
- Use the Service to record content you do not have permission to capture
- Record sensitive information (passwords, financial data, personal data of others) without proper authorization
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the Service
- Interfere with or disrupt the Service or its infrastructure
- Share your account credentials with others
5. Content Ownership
You retain ownership of the guides and recordings you create with Capture. By using the Service, you grant us a limited license to process, store, and display your content as necessary to provide the Service. When you share a guide publicly, you grant others the right to view that content.
6. Subscription and Billing
Capture offers free and paid plans. Paid subscriptions are billed monthly or annually through Stripe. You can cancel your subscription at any time — your access continues until the end of the current billing period. Refunds are handled on a case-by-case basis.
7. AI-Generated Content
Guide descriptions are generated by AI and may not always be perfectly accurate. You are responsible for reviewing and editing AI-generated content before sharing it with others. We do not guarantee the accuracy of AI-generated descriptions.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
9. Service Availability
We strive to keep Capture available at all times but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.
10. Limitation of Liability
To the maximum extent permitted by law, Capture and Kyx AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.
